Kumd 利用規約 (Terms of Service)

第1条（総則および同意）
本利用規約（以下「本規約」）は、pyonkai-technology（以下「運営者」）が提供するアプリケーション「Kumd」および関連サービス（以下「本サービス」）の利用条件を定めます。ユーザーは本サービスを利用することで、本規約およびプライバシーポリシーに同意したものとみなされます。
第2条（サービスの目的および定義）
本サービスは、ユーザーが作成・編集するプレーンテキストおよびMarkdownファイル（.md）を端末ローカルに保存し、ユーザー自身のGoogle Driveアカウントと自律的に同期するローカルファーストのテキストエディタツールです。
第3条（コンテンツ所有権・ローカルファーストおよびデータ非保持）
1. 完全なコンテンツ所有権: 本サービスを通じて作成・編集・保存されたすべてのテキスト、ドキュメント、およびフォルダ構造の著作権その他の権利は、100%ユーザー自身に帰属します。運営者がユーザーのコンテンツに対する権利を取得またはライセンス供与を受けることはありません。
2. ローカルファースト設計と独自サーバー不使用: 本サービスは端末内ローカルストレージおよびユーザー自身のGoogle Driveアカウントとのみ直接通信します。運営者はユーザーのメモ本文やファイル内容を収集・蓄積・閲覧・解析するための独自サーバーを運用しておらず、運営者のサーバーにユーザーデータが送信・保存されることは恒久的にありません。
第4条（データ保護および免責事項）
1. データの保護: 運営者は、ユーザーの思考と編集内容を保護するため、自動保存や端末内保存、編集衝突時のデータ保護等、最善の技術的努力を尽くします。
免責事項: 運営者はデータの保全に最大限努めますが、端末の急激な電源断、OSによるアプリの終了、Google Drive側の障害や制限、通信障害、オフライン状態の長期継続等に起因するデータの滅失・毀損・同期遅延について、責任を負いません。大切なデータはユーザー自身でも定期的に外部バックアップを保存してください。
第5条（有料サブスクリプションおよび課金）
本サービスは無料プラン（Free）および有料定期購入プラン（Pro）を提供します：
- 月額プラン: ¥380 / 月（税込）
- 年額プラン: ¥2,980 / 年（税込）※7日間の無料トライアルが付与される場合があります。
- ※ Google Play 上に表示される現地通貨および税込価格に準じます。
課金の主体（Merchant of Record）: 本サービスの有料プランは、Google Playのアプリ内課金（IAP）を通じて提供されます。課金処理・請求・決済はGoogle LLCが販売主体として直接行います。運営者は課金処理・決済の当事者ではなく、クレジットカード情報等を保持しません。
自動更新: 請求期間終了の少なくとも24時間前までに解約しない限り、定期購入は同期間・同金額で自動的に更新されます。請求期間終了前の24時間以内にGoogle アカウントへ請求が行われます。
解約手順: Google Playの「お支払いと定期購入」＞「定期購入」からいつでも解約可能です。アプリをアンインストールしても定期購入は解約されません。
返金方針: 決済処理はGoogle LLCが直接行います。返金を希望される場合は、Google Playの返金ポリシーに従ってプラットフォームへ直接申請してください。
第6条（認証情報およびGoogle Driveトークンの保護）
Google アカウントの連携に必要な認証情報は、端末内部（アプリ領域）にのみ保持され、運営者のサーバーに送信・保存されることは一切ありません。
第7条（禁止事項）
ユーザーは、本サービスのリバースエンジニアリング、逆コンパイル、Google Drive APIに対する不正なリクエスト送信や過度な負荷をかける行為、法令または公序良俗に違反する行為を行ってはなりません。
第8条（損害賠償の制限および準拠法）
運営者の損害賠償責任は、直近12ヶ月間にユーザーが本サービスのProプランに関してGoogle Playに現実に支払った利用料金の総額を上限とします。本規約の解釈にあたっては、日本法を準拠法とします。

1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Kumd mobile application and related services provided by pyonkai-technology ("Operator", "we", "us"). By downloading, installing, or using the Service, you agree to be bound by these Terms and our Privacy Policy.
2. Description of the Service
Kumd is a local-first plain text and Markdown editor application designed to provide distraction-free mobile note-taking with autonomous synchronization directly to your personal Google Drive account.
3. Content Ownership, Local-First & Zero Intermediate Server
1. 100% User Ownership: You retain full copyright, ownership, and all intellectual property rights in all notes, documents, and folder hierarchies you create or edit using the Service. The Operator does not claim any rights over your content.
2. Local-First & Zero Server: Kumd communicates directly with your device's local storage and your personal Google Drive account. We do not operate external intermediary servers that collect, store, inspect, or process your note contents. Your notes never touch our servers.
4. Data Protection and Disclaimer
1. Data Protection: We implement industry-standard practices, such as automatic background saving and conflict handling, to protect your notes from data loss.
Disclaimer: While we exercise utmost technical care, the Operator is not liable for data loss, file corruption, or sync delays resulting from abrupt power loss, operating system process termination, Google Drive service outages or quota limits, network disconnection, or prolonged offline usage. You are encouraged to maintain independent backups of critical data.
5. In-App Subscriptions & Billing
Kumd offers a Free tier and an auto-renewing Pro Subscription:
- Monthly Plan: ¥380 / month (or local equivalent)
- Yearly Plan: ¥2,980 / year (or local equivalent), which may include a 7-day free trial.
Merchant of Record: All paid subscriptions are sold, billed, and processed directly by Google LLC (Google Play) as the Merchant of Record. The Operator does not collect or process credit card numbers or financial information.
Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours prior to the end of the current billing cycle. Your Google Play account will be charged within 24 hours prior to the end of the period.
Cancellation: You can manage or cancel your subscription anytime via your device settings: Google Play Store > Profile > Payments & subscriptions > Subscriptions > Kumd. Uninstalling the app does not automatically cancel your subscription.
Refunds: All payments and refunds are handled directly by Google Play in accordance with Google Play Refund Policies.
6. Security of Credentials & Google Drive Tokens
Authentication credentials required to connect your Google Account are stored locally within the application's private storage on your device. They are never transmitted to or stored on our servers.
7. Prohibited Conduct
You agree not to: (a) reverse engineer, decompile, or disassemble the application; (b) send unauthorized or excessive requests to Google Drive APIs; or (c) violate applicable laws or public order.
8. Limitation of Liability & Governing Law
To the fullest extent permitted by applicable law, the Operator's total liability shall not exceed the aggregate amount actually paid by you for the Kumd Pro subscription during the 12 months preceding the claim. These Terms are governed by and construed in accordance with the laws of Japan.
